Terms of Service

1. The Service

Promptly AI is a marketplace where creators ("Creators") publish prompts for use with AI tools, and users ("Buyers") may browse, save, and purchase those prompts. Creators may earn revenue from sales and withdraw earnings to a registered bank account.

2. Accounts & eligibility

• You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and transact.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You must provide accurate, current and complete information and keep it up to date.
• You may not create multiple accounts to circumvent limits, fees or restrictions.
• We may suspend or terminate accounts that violate these Terms, our policies, or applicable law.

3. Plans & subscriptions

• Free: browse, save and post unlimited free prompts.
• Pro (₹49/month): unlimited daily posts, publish paid prompts, 5% platform fee on sales.
• Creator (₹99/month): everything in Pro, plus 0% platform fee, priority visibility and creator badge.
• Subscriptions recur monthly through Razorpay until cancelled. You may cancel anytime; access continues until the end of the paid period.
• Prices are in Indian Rupees (INR) and include applicable GST unless stated otherwise.

4. Purchases & prompt delivery

• Buying a paid prompt grants you a non-exclusive, non-transferable, worldwide licence to use the prompt text for your own AI generation projects.
• You may not resell, redistribute, republish or sublicense purchased prompt text, or include it in competing prompt marketplaces, without the Creator's written consent.
• Purchase unlocks the full prompt text instantly after payment verification.
• Free prompts are licensed for personal and commercial use unless the Creator states otherwise in the prompt description.

5. Creator obligations

• You must own or have the right to publish every prompt you post.
• Prompts must not infringe third-party intellectual property, privacy or other rights.
• Prompts must not promote illegal, harmful, deceptive or offensive content, or generate content that violates applicable law.
• You may not artificially inflate views, saves or sales of your prompts.
• Creators earn a net amount after platform fees and applicable payment-processing fees are deducted.

6. Fees & earnings

• Purchases: platform fee is determined by the Buyer's plan (Pro 5%, Creator 0%, otherwise 0%).
• Withdrawals: a 2% Razorpay processing fee plus 18% GST on that fee is deducted from each withdrawal, in addition to any applicable platform fee.
• Minimum withdrawal is ₹60. Withdrawals require an active Pro or Creator plan and registered bank account details.
• Withdrawals are paid to your registered bank account on the schedule published in the Service (typically within 3–5 business days after admin verification).
• We reserve the right to adjust fee structures with reasonable advance notice.

7. Prohibited conduct

• Scraping, hacking, or interfering with the Service or other users' accounts.
• Using the Service to distribute malware, spam, or unlawful content.
• Attempting to defraud Creators, Buyers or the platform (including chargeback abuse).
• Impersonating others or providing false information.

8. Intellectual property

The Promptly AI name, logo, design, and software are owned by Play Bold Studio. Your content remains yours; by publishing it you grant us a licence to host, display and promote it on the Service and in related marketing, and to process it for the purpose of the marketplace.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that AI prompts will produce any particular results.

10. Limitation of liability

To the maximum extent permitted by law, Play Bold Studio shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or other intangible losses, arising out of or related to your use of the Service or any purchases or earnings. Our total aggregate liability shall not exceed the greater of the amounts you paid us in the 12 months preceding the claim or ₹10,000.

11. Indemnification

You agree to indemnify and hold harmless Play Bold Studio, its affiliates, officers and employees from any claims, damages, liabilities and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at our discretion, including for violation of these Terms. On termination, paid subscription access ends, and any outstanding earnings will be paid in accordance with our payout process unless forfeited for fraud or breach.

13. Governing law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Namakkal, Tamil Nadu, India, provided that nothing limits our right to seek injunctive or other equitable relief.

14. Changes to these Terms

We may revise these Terms from time to time. Material changes will be posted on this page and, where feasible, notified to you. Continued use of the Service after changes take effect constitutes acceptance.
